What your contract should already say: client, supplier with its own model and third parties with frontier AI
What your contract should already say

Your suppliers and customers use AI. Do your contracts say so?

More and more industrial companies are setting out their AI policy: how tools are chosen, what information can be shared, with which accounts, and who is trained to use it. But those criteria cannot stay in-house.

Contracts already cover the GDPR, privacy and confidentiality. Almost none address the framework for using AI. And part of what is delivered to us is already made with AI: sometimes with the supplier’s own model; often with several frontier AIs from the big technology companies.

It is not about distrust, it is about traceability.

Four things to ask for:

  1. Which AI is used, and what for.
  2. What is done with the data.
  3. Notice if the model changes.
  4. What controls there are over the results.

The European Commission has already published model AI clauses for public procurement. It is a sign of where the market is heading: sooner or later, these questions will reach business-to-business contracts too.

And what I ask of my suppliers, my customers are going to ask of me.
